For a good and proper fit, I would say go for the M. You are pretty much right on the cusp of both sizes, but you are more into the M rather than the S. So for your foot to feel proper in the cage of the binder, go for the M because it will give you more to play around with when adjusting them. Hope this helps :)

Yes it will fit just fine. The M will go up to size 9.5/10 I believe, so you should be good.
